Welcome to Whittney Jayne Photography, LLC. (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website located at [www.yourwebsite.com] (the “Site”) and our portrait photography services (“Services”).

By booking a session or using this Site, you agree to these Terms. If you do not agree, please do not use our services or website.

1. Services Offered

We provide professional portrait photography services, including but not limited to:

• Individual or family portraits
• Graduation and senior portraits
• Engagement and couple sessions
• Maternity and newborn photography
• Business and personal branding/headshots
• Sports action and athletic portraits

Services are subject to availability and change.

2. Booking and Payment

a. Booking

Sessions must be booked in advance. Payment of the session fee is required to secure your session date.

b. Deposits and Cancellations

• A non-refundable Session Fee is required to confirm your booking.
• Cancellations made at least 14 days in advance may be rescheduled once without penalty.
• Late cancellations, no-shows, or failure to communicate result in forfeiture of the Session Fee.

c. Payment

Session Fee must be paid in full before the session date unless otherwise arranged in writing. Full payment for purchases of digital images and/or prints after the session is due upon order. We accept credit cards, bank transfer, cash, and approved checks.

3. Delivery of Photographs

• Your selected high-resolution digital images will be received within 14 days of payment.
• Delivery will be via a private online gallery.
• RAW/unprocessed files are not included, unless explicitly agreed to in writing.
• You may order physical prints, albums, or other products separately.

4. Usage Rights and Copyright

a. Photographer’s Rights

We retain full copyright to all images. We reserve the right to use images for promotional purposes with your written permission, obtained through a model release form in the client contract.

b. Client’s Rights

Clients are granted personal use rights to share, post (with credit), and print images. Commercial use, resale, or altering of images is prohibited without our express written permission.

5. Model Release

By agreeing to these Terms and/or signing a session agreement or model release form, you grant Whittney Jayne Photography, LLC. permission to use photographs from your session — including your likeness — for promotional purposes including, but not limited to:

• Website portfolio
• Social media pages
• Print or digital marketing materials
• Photography competitions or publications

This release is optional. To request removal of this clause, you must explicitly express your desire to opt out in writing.

6. Client Responsibilities

• You are responsible for arriving on time and prepared.
• For minors, a parent or legal guardian must be present and consent to all terms.
• If your session is held at a private location, you are responsible for securing access or permissions.

7. Rescheduling and Weather

We allow one complimentary reschedule with at least 14 days’ notice. Sessions may be rescheduled due to weather, emergencies, or illness at our discretion. If we must cancel, you will be offered a reschedule or a full refund of any paid fees (excluding delivered services).

8. COVID-19 Disclaimer

By booking a session, you confirm that:

• You and anyone participating are not experiencing symptoms of COVID-19 or other contagious illnesses.
• You have not been in close contact with a confirmed COVID-19 case within the past 10 days.
• You will notify us immediately if your health status changes prior to the session.

We reserve the right to reschedule sessions to protect the health of our clients and team. All sessions will comply with local health and safety guidelines in place at the time of your booking.

9. Limitation of Liability

While we take every care to deliver quality work, Whittney Jayne Photography, LLC. is not liable for:

• Delays or losses caused by weather, illness, equipment failure, or events beyond our control
• Missed shots due to client lateness or uncooperative behavior
• Any indirect, incidental, or consequential damages related to use of our services

In all cases, our maximum liability shall not exceed the amount paid for the session.

10. Intellectual Property

All content on this Site (including images, text, and branding) is the property of Whittney Jayne Photography, LLC. and may not be copied, modified, or redistributed without written permission.

11. Privacy Policy

Your privacy is important to us. Please see our full Privacy Policy to learn how we collect, store, and use your personal data.

12. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Washington, without regard to conflict of law principles. Any disputes will be handled in the courts located in Washington, United States.

13. Changes to These Terms

We may update these Terms at any time. The latest version will always be posted on our website with an updated effective date. Continued use of the Site or our Services constitutes your acceptance of any changes.
